Susan Atkinson, a consultant solicitor at Keystone Law, takes a look at current thinking on how contracts for software development can better support the delivery of the desired business outcomes.

When used effectively, Agile methods are shown to deliver better results from software. But “effective Agile” is a root-and-branch transformation that encompasses the end-to-end process. Where that process includes outsourced suppliers, contract terms need to be aligned to the delivery of value, recognising the responsibilities of both parties and providing suppliers with the right incentives as well as satisfying the client’s need to manage risk.

Susan Atkinson has been working with Gabrielle Benefield, a co-founder of the Scrum Foundation and an advocate of Lean, on how to construct contracts that meet this brief.
